EPMU: High Court refuses to second-guess the Electoral Commission's factual evaluation

The High Court has dismissed the application for review: > Kirk v Electoral Commission (28.08.2008) It's broadly consistent with my (preferred) analysis, noted earlier: > LAWS179: "EPMU, Electoral Commission, and jurisdictional facts" My only quibble is the expression of the principle in terms of the statutory appeal standard, rather than judicial review principles, although admittedly they are quite similar.
